1. INTRODUCTION
1.1 This Vendor Agreement ("Agreement") is entered into between Lekka Card (Pty) Ltd, registration number 2026/639607/07 ("Lekka," "we," "us," or "our") and you, the business entity or sole proprietor ("Vendor," "you," or "your") subscribing to the Lekka Card platform.
1.2 By creating a vendor account and using our Services, you accept and agree to be bound by this Agreement, our Privacy Policy & Terms of Use, and all applicable laws and regulations.
1.3 If you do not agree to these terms, you must not use the Lekka Card platform.
1.4 This Agreement constitutes the entire agreement between you and Lekka Card regarding your use of the platform and supersedes all prior agreements.
2. DEFINITIONS
In this Agreement, unless the context otherwise requires:
- "Services" means the Lekka Card loyalty platform, including web interface, customer-facing features, vendor dashboard, and all related tools and functionality.
- "Programme" means your loyalty programme created and managed through the Lekka Card platform.
- "Customer" means an individual who has joined your Programme through Lekka Card.
- "Stamp" means a digital loyalty credit issued to a Customer through the Lekka Card system.
- "Reward" means the benefit offered to Customers upon completing a Programme (e.g., free coffee after 10 stamps).
- "Subscription" means your plan tier (Free, Starter, Growth, or Premium) as selected in your vendor dashboard.
- "Platform" means the Lekka Card website, mobile web application, and all associated systems and infrastructure.
3. SERVICES PROVIDED BY LEKKA CARD
3.1 Lekka Card provides you with access to a digital loyalty platform that enables you to:
- Create and manage a digital loyalty programme for your business
- Issue digital stamps to customers via QR code scanning
- Track customer participation and programme performance
- Communicate with enrolled customers via broadcast messages (paid plans, subject to fair-use limits)
- Access analytics and reporting on programme activity
3.2 Lekka Card is a platform provider only. We facilitate the technology and infrastructure but do not operate your Programme on your behalf.
3.3 We do not guarantee any specific number of customer sign-ups, programme engagement, or business outcomes. Results depend on your own marketing, customer service, and business practices.
4. VENDOR OBLIGATIONS
4.1 Accurate Information: You must provide complete and accurate business information, including business name, address, contact details, and any required registration or tax numbers.
4.2 Lawful Operation: You must operate a legitimate business in compliance with all South African laws, including consumer protection, health and safety, and tax obligations.
4.3 Honour Rewards: You agree to honour all rewards issued through the Lekka Card platform. Refusing to redeem a valid reward constitutes a breach of this Agreement.
4.4 Fair Treatment: You must not discriminate against customers based on race, gender, religion, disability, or any other protected characteristic when issuing stamps or redeeming rewards.
4.5 Programme Integrity: You must not manipulate, abuse, or circumvent the stamp issuance system. Issuing fraudulent stamps or colluding with customers to exploit the Programme is strictly prohibited.
4.6 Customer Service: You are solely responsible for all customer interactions, disputes, and service quality. Lekka Card is not liable for any issues arising from your business operations.
4.7 Marketing Materials: You are responsible for obtaining and displaying Lekka Card QR codes at your point of sale. We provide digital assets; you must ensure they are visible and accessible to customers.
5. PRICING & PAYMENT TERMS
5.1 Subscription Fees: Pricing is determined by your selected plan tier (Free R0, Starter R249/month, Growth R499/month, Premium R999/month, or Enterprise, which is priced by arrangement) and billing frequency (monthly, or annual at a discount). These are the total amounts payable.
5.2 Current Pricing: Pricing details are published at lekkacard.co.za/vendor/pricing and may be updated from time to time with 30 days' notice.
5.3 Payment Method: Subscription fees are invoiced by email and are due 14 days after the invoice date. Each invoice can be paid online through its "Pay now" link (card, instant EFT, Scan to Pay or Capitec Pay, processed by our payment provider, Paystack) or by electronic funds transfer (EFT) to the bank details on the invoice. We do not debit your card automatically. If you pay by card, Paystack may keep a secure token for that card; Lekka Card never sees or stores your card number.
5.4 Billing Cycle:
- Monthly subscriptions are invoiced on the same date each month.
- Annual subscriptions are invoiced once per year and include a discount compared to monthly billing.
5.5 Unpaid Invoices: If an invoice remains unpaid 14 days after its due date, your paid features may be suspended (your account moves to the Free tier) until payment is received. Your customers' cards, stamps and rewards keep working throughout.
5.6 Late Fees: We do not charge late fees. We send email reminders before and after the due date. Paying an overdue invoice restores your paid plan automatically. An account that stays unpaid may be terminated as set out under "Termination by Lekka Card" in section 13.
5.7 Taxes: Lekka Card is not a VAT vendor, so no VAT is charged on our fees and the price you see is the price you pay. Should Lekka Card become VAT registered, VAT may be added to fees from a future date, and we will give you 30 days' written notice before that happens. You remain responsible for any taxes arising from your own use of the Services.
5.8 Price Changes: We reserve the right to change pricing with 30 days' written notice. Existing annual subscriptions will not be affected until renewal.
6. SUBSCRIPTION PLANS & LIMITS
6.1 Plan Tiers: Lekka Card offers five plan tiers, each with different feature limits:
- Free: An entry tier limited to 50 enrolled customers and a single loyalty programme, with no time limit
- Starter: For single-location businesses, limited to 250 enrolled customers
- Growth: For growing businesses requiring more programmes and locations, limited to 500 enrolled customers
- Premium: For established businesses with multiple locations and advanced features, limited to 1,000 enrolled customers
- Enterprise: For groups and franchises, priced by arrangement, with no customer limit
6.2 Plan Limits: Every self-serve tier carries an enrolled-customer limit (Free 50, Starter 250, Growth 500, Premium 1,000); Enterprise has no limit. Vendors who were on a paid plan before September 2026 keep the limits they had. Plans also differ on loyalty programmes, locations, and features, as published on the pricing page. At a customer limit, existing Customers are unaffected and new signups are placed on a waiting list until you upgrade.
6.3 Broadcast Messages: Broadcast messages (email and in-app) are not available on the Free tier. On paid tiers, broadcasts are unlimited, subject to a fair-use rule: each Customer may receive no more than one broadcast from you in any 7-day period.
6.4 Locations: Starter is a single-location plan. Growth includes 1 location and supports up to 2, with the additional location at R199/month. Premium includes 3 locations and supports up to 5, with each additional location at R199/month. Enterprise location pricing is by arrangement.
6.5 Team accounts: On Growth and Premium, each active staff login beyond the owner is charged at R25/month, up to the plan's allowance (10 on Growth, 50 on Premium). Deactivating a login stops the charge from the next invoice.
6.6 Upgrades: You may upgrade your plan at any time from Billing & plan in your vendor dashboard, or by contacting us at hello@lekkacard.co.za. The new plan starts once payment for it is received.
6.7 Downgrades: To move to a lower plan, contact us at hello@lekkacard.co.za. A downgrade takes effect at the end of your current billing period. Mid-cycle downgrades are not permitted, and no refunds are issued for unused time.
6.8 Free Allowance: New vendors may start on the Free tier at no cost and with no time limit, up to 50 enrolled customers. Paid plans are billed from the first month.
7. CUSTOMER DATA & PRIVACY
7.1 Data Sharing: When a customer joins your Programme, Lekka Card shares their name, email, and phone number (if provided) with you. This data is provided to enable you to operate your loyalty programme.
7.2 Your Role as Data Controller: You are an independent controller of customer data under POPIA. You are solely responsible for:
- Using customer data only for legitimate Programme purposes
- Protecting customer data in accordance with POPIA requirements
- Responding to customer data access, correction, and deletion requests
- Maintaining your own privacy policy and compliance procedures
7.3 Lekka's Role: Lekka Card acts as a data processor for certain functions (stamp issuance, reward tracking) but is not responsible for your independent use of customer data.
7.4 Prohibited Uses: You must not:
- Sell, rent, or share customer data with third parties without explicit customer consent
- Use customer data for purposes unrelated to your Programme
- Spam customers or send excessive marketing communications
- Retain customer data longer than necessary after they leave your Programme
7.5 Data Breaches: You must notify Lekka Card immediately if you become aware of any unauthorised access to or disclosure of customer data obtained through the platform.
7.6 Data Deletion: If a customer requests deletion of their data, you must comply within 30 days and notify Lekka Card so we can remove them from our shared records.
8. PROGRAMME MANAGEMENT
8.1 Programme Design: You have full control over your Programme structure, including:
- Number of stamps required for a reward
- Description and value of the reward offered
- Programme name and branding
- Terms and conditions specific to your Programme
8.2 Programme Changes: You may modify your Programme at any time, but you must honour rewards already in progress. For example, if a customer has 8 stamps toward a 10-stamp reward and you change it to 12 stamps, existing customers must be allowed to complete their reward at 10 stamps.
8.3 Programme Closure: If you close or pause your Programme, you must honour all outstanding rewards before doing so. Customers with stamps toward a reward must be allowed to redeem them.
8.4 Reward Expiry: You may set expiry dates for stamps or rewards, but these must be clearly communicated to customers in your Programme terms.
8.5 Transparency: You must clearly display your Programme terms, reward details, and any restrictions or exclusions at your point of sale and in your Programme description on Lekka Card.
9. REWARD REDEMPTION
9.1 Redemption Process: Customers redeem rewards by tapping "Claim My Reward" in their Lekka Card account and showing the confirmation screen to you. No QR scan is required from the vendor side.
9.2 Verification: You must verify that the customer's account shows an active, unredeemed reward before honouring it.
9.3 Redemption Obligations: Once a customer has earned a reward, you must honour it in accordance with your Programme terms. Refusing a valid redemption is a breach of this Agreement.
9.4 Disputes: If you believe a redemption is fraudulent or invalid, you must contact Lekka Card support immediately. Do not refuse redemption without contacting us first.
9.5 Record Keeping: All redemptions are logged in the Lekka Card system. You can view your redemption history in your vendor dashboard.
10. COMPLAINTS PROCESS
10.1 Customer Complaints About Your Business: You are solely responsible for handling customer complaints related to your business, products, services, or Programme operations. Lekka Card is not liable for disputes between you and your customers.
10.2 Platform Issues: If a customer experiences technical issues with the Lekka Card platform (e.g., stamps not appearing, app errors), they should contact Lekka Card support directly at hello@lekkacard.co.za.
10.3 Vendor Complaints About Lekka Card: If you have a complaint about Lekka Card's Services, you may submit it to:
- Email: hello@lekkacard.co.za
- Subject Line: "Vendor Complaint - [Your Business Name]"
- Response Time: We will acknowledge your complaint within 3 business days and provide a resolution or update within 10 business days.
10.4 Escalation: If you are not satisfied with our response, you may escalate the matter to:
- Consumer Goods and Services Ombud: www.cgso.org.za
- Information Regulator (for data privacy matters): inforeg@justice.gov.za
10.5 Customer Complaints About Vendors: If Lekka Card receives multiple complaints about your business (e.g., refusing redemptions, poor service, discriminatory practices), we reserve the right to suspend or terminate your account.
11. VENDOR LISTING PAGES & PUBLIC DATA
16.1 What Are Vendor Listing Pages? Lekka Card creates public-facing listing pages for local businesses to promote discovery and customer engagement. These pages display information about your business, including:
- Business name, location, and opening hours
- Photos of your venue, products, or services
- Business descriptions and reviews
- Links to your social media profiles (Instagram, Facebook, TikTok, etc.)
- Google Reviews and ratings
- Information about your Lekka Card loyalty programme
16.2 Data Sources: Information on vendor listing pages is compiled from publicly available sources, including:
- Google Places: Business name, address, phone number, opening hours, and reviews
- Social Media: Public Instagram, Facebook, and TikTok profiles, posts, and photos
- Lekka Card Site Visits: Our team may visit your business to take photos, write descriptions, and add our own reviews
- User-Generated Content: Photos and reviews submitted by Lekka Card customers
16.3 Listing Creation Before Registration: Lekka Card may create a listing page for your business before you register as a vendor. This is done to:
- Promote local businesses and help customers discover new places
- Showcase businesses that align with Lekka's mission to support local commerce
- Encourage businesses to join the platform and offer loyalty programmes
If a listing page exists for your business before you register, you will automatically gain control of that page upon registration.
14.4 Claiming Your Listing: When you register as a vendor:
- You gain full control over your listing page content
- You can edit business details, upload photos, and update your description
- You can activate your loyalty programme and start issuing stamps
- You can opt out of public listing visibility (though this limits customer discovery)
14.5 Public Data Usage Rights: By operating a business with a public presence (Google Maps listing, social media profiles, etc.), you acknowledge that:
- Your business information is publicly available and may be aggregated by platforms like Lekka Card
- Lekka Card has the right to display publicly available information about your business
- Photos and content from your public social media profiles may be featured on your listing page
- Reviews from Google and other public sources may be displayed on your listing
13.6 Opting Out or Requesting Changes: If you do not want a listing page for your business on Lekka Card, you may:
- Before Registration: Email hello@lekkacard.co.za requesting removal of your listing. We will remove it within 7 business days.
- After Registration: You can hide your listing from public view in your vendor dashboard settings.
If you believe any information on your listing page is inaccurate or violates your rights, contact us immediately and we will review and update it within 5 business days.
12.7 Intellectual Property & Content Ownership:
- Your Content: You retain all rights to photos, logos, and descriptions you upload to your listing.
- Public Content: Content sourced from public profiles (social media, Google) is used in accordance with fair use and platform terms.
- Lekka Content: Photos and reviews created by Lekka Card staff remain our property but are provided to you for use in promoting your business.
12.8 User Reviews & Ratings: Lekka Card may enable customer reviews and ratings on your listing page. You agree that:
- Reviews are the opinions of individual customers and do not represent Lekka Card's views
- Lekka Card is not liable for negative reviews or customer complaints posted on your listing
- We reserve the right to remove reviews that violate our content policy (spam, hate speech, etc.)
- You may not incentivise, manipulate, or fabricate reviews
12.9 No Guarantee of Visibility: While we strive to promote all vendors fairly, Lekka Card does not guarantee:
- Your listing will appear in search results or recommendations
- Any specific number of page views or customer engagement
- That your listing will rank higher than competitors
Listing visibility depends on factors including customer behaviour, programme activity, business quality, and algorithmic ranking.
12. INTELLECTUAL PROPERTY
16.1 Lekka Card IP: All content, branding, logos, software, and technology provided by Lekka Card remain our exclusive property. You are granted a limited, non-exclusive, non-transferable licence to use the platform solely for operating your Programme.
16.2 Your IP: You retain all rights to your business name, logo, and branding. By uploading assets to Lekka Card, you grant us a licence to display them on the platform for the purpose of promoting your Programme.
16.3 Use of Lekka Card Branding: You may display Lekka Card branding and QR codes at your business to promote your Programme. You must not alter, misuse, or misrepresent Lekka Card's brand.

13. SUSPENSION & TERMINATION
16.1 Termination by You: You may cancel your subscription at any time by:

16.2 Effect of Cancellation: Upon cancellation:
- Your paid plan remains active until the end of your current billing period, and no further invoices are issued after it
- No refunds are issued for unused time
- Your account then moves to the Free tier, so your Customers' cards keep working, unless you ask us to close your account entirely
- If you close your account, Customers can no longer collect stamps with you, and you must honour all outstanding rewards before your Programme closes
- You can export your customer list at any time before your account is closed
16.3 Suspension by Lekka Card: We may suspend your account immediately if:
- An invoice remains unpaid 14 days after its due date (for non-payment, suspension means your paid features are paused and your account moves to the Free tier, as set out in clause 5.5)
- You violate this Agreement or our Terms of Use

- Your business is found to be operating unlawfully
14.4 Termination by Lekka Card: We may terminate your account with 30 days' written notice if:
